The Ombudsman found that portions of a closed session discussion held by council for the Township of Strong regarding the conduct of a council member fit within the exception for personal matters about an identifiable individual. These portions of the discussion went beyond scrutiny of a council member in their professional capacity and included discussion of unsubstantiated allegations about the council member’s conduct. While other portions of the discussion regarding the council member’s professional conduct and communications did not fit within the exception for personal matters on their own, the Ombudsman found that that the entire discussion could not realistically have been parsed between open and closed sessions. Accordingly, council’s entire closed session discussion was permitted under the Municipal Act, 2001.
