The Ombudsman received a complaint about a closed meeting held on August 19, 2020, by council for the Township of Lake of Bays. The complainant alleged that council decided to approve a licence of occupation application while in closed session and that the topic of discussion did not fit within the closed meeting exceptions in the Municipal Act. While the discussion did not fit within the “litigation or potential litigation” exception cited by council, the Ombudsman found that the discussion fit within the “solicitor-client privilege” exception pursuant to s.239(2)(f) of the Act.
