The Ombudsman found that an October 31, 2010 gathering including one incumbent council member and four councillors-elect with the lawyer for the Fort Erie Waterfront Association was not subject to the open meeting requirements as only one member of council was present and, as such, the attendees did not have the authority to exercise the authority of council.
