The Ombudsman found that council for the Municipality of Central Manitoulin did not contravene the Municipal Act, 2001 when it held a closed session during a special council meeting to receive part of a presentation by external consultants on a local recreation infrastructure project. The Ombudsman found that portions of the presentation and council’s discussion fit within the open meeting exception for a proposed or pending acquisition or disposition of land. Other portions did not fit within the exception, but the Ombudsman found that parsing the discussion between an open and closed session would have detracted from a free and uninterrupted discussion. Accordingly, council’s entire closed session discussion was permitted under the Municipal Act, 2001.
